Before you start using our website (https://www.kcex.com), mobile application, and all related services provided by us (collectively referred to as the "Services"), please carefully read and understand this User Agreement (hereinafter collectively referred to as the "Agreement"). Your access or use represents your agreement to comply with all the terms and conditions set forth in this Agreement, as well as any revisions and updates made by us from time to time.

Considering the involvement of asset transactions and liquidity, we emphasize the importance of ensuring the security of your computer. For the sake of browsing experience and security, we recommend using the latest version of the Google Chrome browser to access KCEX. Please note that any errors or property losses resulting from personal mishandling will be your responsibility.
Risk Warning
In order to provide you with a comprehensive understanding of the risks associated with digital asset trading, we hereby remind you: before starting to use KCEX for digital asset trading, please fully understand and carefully assess the risks involved in digital asset trading. You need to determine your own risk tolerance and decide whether to use KCEX for trading after careful consideration. When using KCEX for digital asset trading, you may face the following risks:
Policy Risk: Changes in macro policies or relevant regulations in your location may affect the normal trading of digital assets, leading to your losses.
Compliance Risk: The risk of violating national laws and regulations during the process of digital asset trading will be borne by you.
Profit Risk: Due to the uniqueness of digital asset trading, its value may fluctuate significantly, and you need to bear the risk of depreciation that may occur.
Trading Risk: The success of a trade depends on the consensus of both parties, and we cannot guarantee that a trade will always be successful.
Force Majeure Risk: Unpredictable and unavoidable circumstances such as natural disasters, wars, strikes, and hacker attacks may affect our normal operation, resulting in your losses.
Digital Asset Delisting Risk: Developers of digital assets may be delisted due to bankruptcy, liquidation, or illegal activities, leading to damage to your assets.
Technical Risk: Technical system failures or errors may affect the trading process, thereby affecting your interests.
Operational Risk: Risks may arise due to operational errors or violations of regulations.
Account Freeze Risk: Suspected illegal activities or defaulting on debts may lead to judicial freezing or execution risks.
By clicking to agree to this Agreement, you understand and agree to bear the risks and losses of transactions on your own. The platform does not guarantee or assume any joint and several liability for the principal and profits of digital assets.
I. General Provisions
Welcome to the KCEX platform (hereinafter referred to as "we" or "platform"). This Agreement includes the general provisions, the Know Your Customer and Anti-Money Laundering Policy, and various rules that we have already or may publish in the future. Before you start using our website (https://www.KCEX.com), mobile application, and all related services provided by us (hereinafter collectively referred to as the "Services"), please carefully read and understand the entire contents of this Agreement. If you have any questions about the Agreement, please consult us. You may not claim that this Agreement is invalid or request its revocation on the grounds of not having read this Agreement or not having obtained answers to your questions. We reserve the right to modify the terms of this Agreement. The modified Agreement will be effective immediately upon publication and will replace the original Agreement. You can check the latest Agreement at any time. Your use, access, or attempted use of the Services indicates your agreement to be bound by the latest User Agreement. If you do not agree, please do not access or use the Services.
II. Qualifications of Registrants
Before completing the registration process or actually using the Services in any other way permitted by KCEX, you should confirm that you are a natural person, legal person, or other organization with full capacity for civil rights and civil conduct. If you do not have the above subject qualifications, you and your guardian will bear all consequences resulting from this, and we have the right to cancel or permanently freeze your account and claim against you and your guardian.
III. Registration and Account
When you fill in the information according to the prompts on the registration page, read and agree to this Agreement, and complete the entire registration process, or fill in the information according to the prompts on the activation page, read and agree to this Agreement, and complete the entire activation process, or actually use the Services in any other way permitted by KCEX, it means that you agree to be bound by this Agreement. You can use your provided email address, mobile number, or other methods permitted by KCEX to log in. During registration, you should provide the information required by laws and regulations, such as your real name, type of identification, and identification number. If the information provided by you during registration is inaccurate, we are not responsible for this, and you will bear any direct or indirect losses and consequences arising from this. We reserve the right, in accordance with market and legal requirements, to restrict or refuse to provide the Services in certain countries.
IV. User Information
During the registration or activation process, you should provide accurate information according to the requirements of relevant laws and regulations, as prompted on the corresponding page, and ensure that your data is updated in a timely manner to keep it true, timely, complete, and accurate. If there is reasonable doubt that the information you provide is incorrect, false, outdated, or incomplete, we have the right to inquire and request you to make corrections. We have the right to suspend or terminate the provision of all or part of the services to you based on the situation. We are not responsible for any loss or additional costs incurred due to your failure to comply with the provisions of this Agreement. You should also ensure the accuracy of the contact information provided by you, such as email address, contact phone number, contact address, and postal code, so that we or other users can contact you effectively. You agree to maintain the effectiveness of this contact information and update it as required by us.
V. Account Security
You are responsible for keeping your KCEX account and password confidential, and you are responsible for all activities in your account (including but not limited to information disclosure, information release, online click agreement or submission of various rules, online renewal of agreement or purchase of services, etc.). You agree to:
(a) Immediately notify us if you discover unauthorized use of your KCEX account or any other violation of this Agreement.
(b) Ensure strict compliance with the website/service's security, certification, transaction, recharge, and withdrawal mechanisms or processes.
(c) Log out of your account at the end of each online session according to the correct steps. We are not responsible for any loss caused by your failure to comply with this Agreement. You understand that we need a certain amount of time to process your request, and we are not responsible for any consequences that occur before the request is processed.
VI. Service Content
Through this service, members can browse real-time market and trading information of various digital asset products on the KCEX platform, submit trading instructions to complete digital asset transactions, participate in activities organized by KCEX, and utilize other related information and technical services.
VII.Service Rules
In the process of conducting transactions on the KCEX platform, if a transaction dispute arises with another user, when either you or the other party or both parties jointly submit a request for arbitration to KCEX, KCEX has the right to make an arbitration decision based on this. You understand and agree that you will accept KCEX's judgment and arbitration decision.
You understand and agree that KCEX has the right to provide necessary information, including user information and transaction records provided by you to KCEX, to government departments (including judicial and administrative departments) upon their request. If you are suspected of infringing on the legitimate rights and interests of others, KCEX also has the right, in the preliminary judgment of the existence of suspected infringement, to provide the necessary identity information to the right holder.
In the process of using KCEX services, you shall bear alone the taxes and all costs related to hardware, software, services, and other aspects incurred.
In the process of using this service on the KCEX platform, you promise to abide by the following agreements:
All actions comply with the normative documents of your country;
- Do not violate public interests or public morals;
- Do not harm the legitimate rights and interests of others;
- Do not evade taxes that should be paid;
- Do not violate this agreement and related rules.
If you violate the above commitments, leading to any legal consequences, you will bear all legal responsibilities independently and compensate KCEX for any losses incurred as a result.
During the transaction process, you shall abide by the principles of honesty and trustworthiness, refrain from engaging in unfair competition, and shall not disrupt the normal order of trading, including but not limited to price manipulation, wash trading, self-trading, front-running, stuffing, fraud, or layered orders.
Furthermore, you may not commercially utilize any data on KCEX, including but not limited to copying or disseminating the information displayed on KCEX in any way without prior written consent from KCEX.
In addition to the above, you shall also refrain from:
(i) Using any deep links, page scraping, robots, spiders, or other automatic devices, programs, scripts, algorithms, or methods to access, retrieve, copy, or monitor any part of the program properties without prior consent from KCEX, or in any way circumventing the structure or presentation of KCEX services to obtain any material, documents, or information;
(ii) Unauthorized access to any part of the program properties or any function of KCEX by hacking, password "mining," or other illegal or prohibited means, or connecting to any other system or network of KCEX services or any other system or network constituting KCEX services;
(iii) Probing, scanning, or testing vulnerabilities in KCEX services or any network connected to the program properties, violating the security or authentication measures on KCEX services or any network connected to KCEX services;
(iv) Reverse looking up, tracking, or seeking to track any information about any other user or visitor of KCEX services;
(v) Taking any action that imposes an unreasonable or disproportionately large load on the infrastructure of KCEX services or the systems or networks connected to KCEX services;
(vi) Using any device, software, or routine procedure to interfere with the normal operation of KCEX services or any transactions conducted on KCEX services, or the use of KCEX services by any other person;
(vii) Forging headers, impersonating others, or otherwise manipulating identifiers to disguise your identity or the source of any message you send to KCEX;
(viii) Using KCEX services in any other illegal manner or in a manner deemed by KCEX to be inconsistent with fairness or community values.
You understand and agree:
(a) KCEX has the right to unilaterally determine whether you have violated the above commitments and to process or terminate the provision of services to you in accordance with the results, without obtaining your consent or providing prior notice. In order to maintain the normal trading order and safety of KCEX, if there are situations such as malicious selling or buying that disrupt the normal market trading order, KCEX has the right to take appropriate risk control measures based on the actual situation, including but not limited to closing the corresponding trading orders, freezing related accounts, restoring affected trading information, and recovering related losses, and reporting the relevant events to the judicial authorities in your jurisdiction.
(b) If your illegal or infringing behavior is confirmed by effective legal documents from the administrative or judicial authorities in your country, or according to KCEX's judgment, your behavior is suspected of violating this agreement or violating the provisions of laws and regulations in your country, KCEX has the right to publicly announce on the KCEX platform your suspected illegal or default behavior and the measures taken. For information posted by you on KCEX that is suspected of being illegal, infringing on the legitimate rights and interests of others, or violating this agreement, KCEX has the right to delete it without notifying you and to impose penalties in accordance with the provisions of this agreement.
(c) For your actions on the KCEX platform, including actions not taken on KCEX but that have an impact on KCEX and its users, KCEX has the right to unilaterally determine the nature of your behavior and whether it constitutes a violation of this agreement, and to impose corresponding penalties accordingly. You shall retain all evidence related to your behavior and bear any adverse consequences that cannot be substantiated. For any damage caused to any third party due to your alleged violation of commitments, you shall independently bear all legal responsibilities in your own name. If your violation causes any loss to KCEX or if any third party makes a claim or if any administrative authority takes action, you shall compensate KCEX for the losses and/or expenses incurred as a result, including reasonable attorney fees.
Limitation of Liability and Disclaimer
11. KCEX is committed to providing services to you as they are and as available. However, we emphasize that KCEX makes no express or implied warranties regarding the applicability, absence of errors or omissions, continuity, accuracy, reliability, or suitability for specific purposes of this service. Additionally, KCEX cannot guarantee the effectiveness, accuracy, correctness, reliability, quality, stability, completeness, or timeliness of the technical aspects and information involved.
12. You should understand that the information on KCEX is posted by users themselves and may carry risks and flaws.
13. KCEX is designed for trading and provides a platform for digital asset information, searching for trading pairs, and negotiating digital asset transactions. However, we cannot control the quality, security, or legality of digital assets involved in transactions, the authenticity or accuracy of trading information, and the ability of the parties involved in a transaction to fulfill their contractual obligations. You should carefully assess and confirm the authenticity, legality, and effectiveness of digital assets and/or information and bear the responsibility and losses arising from it. Unless required by laws and regulations or under the following circumstances, KCEX is not obligated to conduct prior review of information, data related to users, digital asset information, trading behaviors, and transaction-related matters for all users: KCEX has reasonable grounds to believe that a specific user and specific transaction may involve significant illegal or default situations, or KCEX has reasonable grounds to believe that a user's behavior on KCEX may be suspected of being illegal or inappropriate.
14. In accordance with your irrevocable authorization, KCEX or third parties authorized by KCEX have the right to handle disputes arising from transactions between you and other users. They have the right to independently determine the facts of the dispute and apply the rules, and make decisions, including but not limited to adjusting the order status, instructing third-party payment companies to pay disputed amounts to one or both parties. This processing decision is binding on you. If you fail to execute the processing decision within the time limit, KCEX has the right (but not the obligation) to use the funds in your KCEX account or the margin you have deposited with KCEX and its affiliated companies to make the payment.
You must promptly replenish the margin and compensate KCEX and its affiliated companies for the losses, otherwise KCEX and its affiliated companies have the right to directly offset your rights and interests under other contracts and have the right to continue recovery. You understand and agree that KCEX or third parties authorized by KCEX, as non-judicial institutions, can only authenticate evidence in the capacity of ordinary individuals. Therefore, they cannot guarantee that the arbitration result meets your expectations and are not responsible for the arbitration conclusion. If you suffer losses as a result, you agree to seek compensation from the beneficiary yourself.
15. You understand and agree that under the following circumstances, KCEX shall not be liable for any loss of profits, reputation, use, data, etc., or other intangible losses, regardless of whether the possibility has been notified in advance: KCEX has reasonable grounds to believe that a specific user and specific transaction may involve significant illegal or default situations, or KCEX has reasonable grounds to believe that a user's behavior on KCEX may be suspected of being illegal or inappropriate, or the expenses and losses incurred in actions such as purchasing or acquiring data, information, or conducting transactions through KCEX services, or misunderstanding of KCEX services, or other losses related to KCEX services not caused by KCEX.
16. In no event shall KCEX be liable for any inability to provide services or delayed services due to the following reasons: normal equipment maintenance of information networks, connection failures of information networks, computer, communication, or other system failures, power failures, strikes, labor disputes, riots, uprisings, disturbances, insufficient productivity or production materials, fires, floods, storms, explosions, wars, government actions, orders from judicial and administrative authorities, or inactions of third parties.
Termination of Agreement
17. You agree that KCEX has the right to suspend, terminate, partially or completely, KCEX services for any reason at its own discretion, temporarily or permanently freeze (cancel) the permissions of your account on KCEX, and shall not be liable to you or any third party. However, KCEX has the right to continue to retain your user information and transaction data. In the following situations, KCEX has the right to directly cancel your account and terminate this agreement:
(a) After KCEX terminates your service, you register as a user again;
(b) The email address you provided does not exist, cannot receive emails, and you do not change to a valid email address within three working days after KCEX's notification;
(c) The user information you provided is untrue, inaccurate, untimely, or incomplete;
(d) You expressly do not accept the new service agreement;
(e) Other situations where KCEX believes it is necessary to terminate the service.
After the termination or permanent freeze of your account services, KCEX is not obligated to retain or disclose your account information, nor is it obligated to forward messages that you have not read or sent.
18. You agree to:
(a) Even after the contract terminates, KCEX has the right to retain your user information and transaction data.
(b) If you engage in illegal activities or violate the agreement during use, KCEX can still assert relevant rights.
(c) After suspending or terminating the service, you must handle and bear the disputes, losses, or costs arising from related transactions and ensure KCEX is free from losses and costs.
(d) If the digital assets you uploaded before suspending or terminating the service are not traded, KCEX has the right to delete relevant information.
(e) After the service terminates, KCEX is not obliged to retain or disclose your account information, nor obligated to forward unread or unsent messages.
(f) If you have already transacted with other users and partially fulfilled the transaction before the service termination, KCEX may not delete the transaction but has the right to notify the other party.
Intellectual Property Rights
19. KCEX owns the intellectual property rights of all intellectual achievements in this service, including but not limited to website logos, databases, website design, text and graphics, software, photos, videos, music, sound, and their combinations, as well as software compilation, related source code, and software, including small applications and scripts. You may not use these materials or content for commercial purposes, including copying, modifying, copying, transmitting, or using.
20. By accepting this agreement, you voluntarily transfer to KCEX the copyright of any form of information you publish on KCEX, such as reproduction rights, distribution rights, rental rights, exhibition rights, performance rights, projection rights, broadcasting rights, information network dissemination rights, filming rights, adaptation rights, translation rights, compilation rights, and other transferable rights, free of charge and exclusively. KCEX has the right to file a lawsuit for any infringement and obtain compensation. This agreement applies to copyrighted works content protected by copyright law that you publish on KCEX before or after the agreement is signed.
21. When using this service, you may not illegally use or dispose of KCEX's or others' intellectual property rights. You may not publish or authorize information published on KCEX in any form on other websites (and media).
22. Your registration on KCEX or use of this service does not imply the transfer of any intellectual property rights from KCEX to you.
Applicable Law
23. This agreement is established in accordance with Singapore law, and the establishment, interpretation, content, and execution are all subject to relevant Singapore laws and regulations. Claims or lawsuits against KCEX will be under the jurisdiction of Singapore law. You unconditionally obtain exclusive jurisdiction to litigate and appeal in Singapore courts. You agree that any disputes, issues, claims, or lawsuits related to this agreement shall be resolved in Singapore, unless KCEX has a specific agreement for other businesses. The principle of inconvenient forum shall not apply when choosing the jurisdictional court.
II. Customer Understanding of Anti-Money Laundering Policies
1. KCEX commits to strictly comply with Know Your Customer and anti-money laundering regulations and will not deliberately violate the relevant policies in this agreement. We will take measures and employ technology within reasonable limits to ensure the provision of secure services and minimize potential losses due to money laundering activities by suspected criminals. Know Your Customer and anti-money laundering policies include:
(a) Issuing and regularly updating Know Your Customer and anti-money laundering policies to comply with the standards of relevant laws and regulations.
(b) Issuing and updating the operating guidelines and rules of this website to ensure our staff provides services according to these guidelines and rules.
(c) Designing and implementing internal monitoring and transaction control procedures, including strict identity verification and establishing a professional team responsible for anti-money laundering work.
(d) Conducting due diligence and continuous monitoring of customers through a risk prevention approach.
(e) Reviewing and periodically inspecting executed transactions.
(f) Reporting suspicious transactions to regulatory authorities.
Identity Information and Verification Confirmation
2. Depending on the requirements of different jurisdictions and entity types, the content of information we collect may vary. In principle, we will collect the following information from registered individuals:
(a) Basic personal information: Your name, address (including permanent address if different), date of birth, and nationality, etc. Identity documents should be official or similarly authoritative documents issued by official or similar authoritative institutions, such as passports, ID cards, etc.
(b) Valid photos: Before registration, you need to provide a photo of yourself holding the identity document in front of your chest.
(c) Contact information: Phone number, mobile number, and/or valid email address.
3. If you are a company or other legal entity, in order to determine the ultimate beneficial owner of you or the trust account, we will collect the following information:
(a) Company registration and registration certificate; copies of the company's articles of association and memorandum; and
(b) Detailed proof of the company's equity structure and ownership, proving the board resolution authorizing the opening of the website account.
(c) Depending on requirements, submit identity documents for company directors, major shareholders, and website account signatories.
(d) The company's main business address, if different from the mailing address, needs to provide the mailing address. If the local address of the company does not match the main business address, additional documents need to be submitted.
(e) According to the regulations of different jurisdictions and entity types, we may need other certifications and documents issued by certification and authoritative institutions, as well as any documents we deem necessary.
4. We only accept identity information in English or Chinese versions. If not, please translate your identity information into an English version and have it notarized.
5. The requirements for confirmation and verification of identity information are as follows:
(a) You need to provide all pages of the identity document.
(b) You need to provide a photo of yourself holding the identity document in front of your chest.
(c) Copy documents should be checked against the original. However, if there is a trustworthy and suitable certifier who can attest that the copy is an accurate and complete duplicate of the original, the copy is acceptable. These certifiers may include ambassadors, judicial officials, local law enforcement officials, etc.
(d) The request to identify the ultimate beneficiary and account control rights is to determine those individuals who ultimately own or control you as a customer, and to determine whether the ongoing transactions are executed on behalf of others. If it is a company, the identity of major shareholders (e.g., those holding 10% or more of the voting rights) needs to be verified.
Trade Monitoring
6. KCEX may, based on security and actual trading conditions, set and adjust daily trading and digital asset withdrawal limits at any time.
7. In cases of frequent concentration of transactions by a registered user or in situations deemed beyond reasonable, KCEX reserves the right to assess and determine whether it is suspicious.
8. In situations identified by KCEX as suspicious transactions, KCEX may implement restrictive measures such as suspending or refusing the transaction, or possibly reversing the transaction promptly, and simultaneously report to the regulatory authorities, without notifying you.
9. KCEX reserves the right to reject registration applications of individuals not compliant with international anti-money laundering standards or considered politically exposed persons. We have the right to suspend or terminate transactions we deem suspicious at any time, without violating any of your obligations and responsibilities. As of now, KCEX has rejected transactions or registration applications from countries including North Korea, Palau, Rwanda, Cuba, Myanmar, Sudan, Syria, Crimea, Mainland China, Hong Kong, Indonesia, Singapore, Venezuela, Bangladesh, Pakistan, Afghanistan, Canada, and the United States, but this list of restricted countries is not exhaustive. KCEX may adjust this list of restricted countries at any time. You hereby commit that if you become a resident of any of the aforementioned restricted countries or know of any users who are residents of these restricted countries, you will immediately notify KCEX. You understand and agree that if KCEX determines that you have made any form of concealment or false statements regarding your location, nationality, or residence when using our services, we have the right to take appropriate measures to ensure KCEX complies with applicable laws and regulations, including but not limited to closing your account and liquidating any positions in your account.
