This is a guide for law enforcement agencies seeking cooperation from KCEX to obtain user information and/or assets. Please be aware that these guidelines may be revised at any time based on KCEX's independent judgment.
Before submitting a request, you must obtain authorization to access KCEX's Law Enforcement Request Form. Typically, each request is reviewed within 15-20 business days, though complex or large-scale requests may require additional time.
Please note: The Law Enforcement Request Form only authorizes government entities or judicial bodies, as per applicable laws, to seek evidence through the system. By accessing the form, you confirm and commit to being an authorized official of a government or judicial entity. Unauthorized requests will be declined, potentially resulting in legal consequences and referral to the appropriate authorities.
Request for User Information:Authorized law enforcement agencies may submit a request for user information through the Law Enforcement Request Form after obtaining access approval.
Requests for user information must comply with applicable laws. A search warrant, court order, or similar legal document is necessary to compel KCEX to disclose user information.
In some cases, we may require additional information to ensure that the release of information complies with our obligations related to information security and data protection.
Please note: Unless explicitly specified in a formal legal request (such as a warrant or court order), we may notify the relevant user of the request before disclosing any personal data.
Information Preservation: Following receipt of a formal legal request, we will retain user information relevant to criminal investigations for up to 60 days. If an extension of the preservation period is needed, you may submit a formal request for extension through the Law Enforcement Request Form.
Asset Preservation and Freezing Order ('Order'): If a valid Order(s) is requested by an authorized law enforcement agency or judicial body, we may take necessary steps to suspend and freeze the user's account.
We require that ALL Order(s) requests clearly specify the duration for which restrictions on the user's account should remain effective.
We may suspend and freeze user accounts for a maximum period of 30 days unless otherwise specified in the Order(s). If no explicit instructions are provided regarding the suspension period, we will proceed to lift all restrictions.
Asset Recovery: We will only comply with lawful decisions from a competent judicial body (i.e., Court Order) regarding the return of user assets that are subject to proceedings. We do not recognize requests to return/recover assets made solely by law enforcement agencies.
We will require official documents to verify the identity of the authorized official(s) handling the return of assets. Further instructions will be provided prior to the return of assets.
Notes:
1. Acceptance of law enforcement requests through the Law Enforcement Request Form is for convenience and does not waive any objections, including lack of jurisdiction or improper service.
2. We will not review or respond to requests sent by non-law enforcement officials through the Law Enforcement Request Form.
3. Complying with law enforcement requests does not waive any rights and arguments that KCEX has, including disputing competency of respective jurisdictions.
4. KCEX may undertake independent review on the validity of any information and documents received from the Law Enforcement Request Form, and may assess, in KCEX's absolute sole discretion, whether compliance therewith contradicts with KCEX's obligations towards its users, under the User Agreement, Privacy Policy, respective Legal Documents, and the applicable laws.
5. Any references to processing time herein are for informational use only and KCEX makes no guarantee that response will be given within this period of time.
