Welcome to the KCEX platform (hereinafter referred to as "we" or "platform"). Before you start using our website (https://www.kcex.com), mobile application, and all related services provided by us (collectively referred to as the "Services"), please carefully read and understand this Privacy Policy (hereinafter collectively referred to as the "Agreement"). Your access or use represents your agreement to comply with all the terms and conditions set forth in this Agreement, as well as any revisions and updates made by us from time to time.
1. Use of Personal Information
KCEX will use and disclose the following personal information in accordance with this agreement:
(a) Personal registration information provided by you to KCEX and its affiliated companies when registering or activating an account that can log in to our platform (excluding business registration information such as enterprise names that need to be disclosed as required by laws and regulations, as well as information of natural person operators);
(b) When you use KCEX, we will record information on your browser and computer, including but not limited to your IP address, browser type, language used, access date and time, hardware and software feature information, and data on the web pages you request; and
(c) User personal data obtained by KCEX from business partners through legal channels.
If you do not wish for us to collect the above personal data, you may notify our Data Protection Officer in writing to opt out. For more information on opting out, please refer to "Withdraw Consent, Delete, Request Access, or Modify Information Provided to Us". However, please note that opting out or withdrawing your consent for us to collect, use, or process your personal data may affect your use of this service.
2. How We Collect Your Information
The vast majority of personal information we collect is provided directly by you. We will collect and process your information in the following situations:
(a) When you register online, log in, or access KCEX, or use any KCEX services;
(b) When you voluntarily complete any user surveys or provide feedback to us through mail or other channels;
(c) When you use or browse our website or client, we may collect information through cookies from your browser or software;
(d) In other situations mentioned in this agreement, we collect information on our own.
We may also obtain information from public channels or third-party channels, such as our advertising and market research partners, to update or supplement your other information.
3. How We Use Your Personal Information
We may use your personal information in the following ways:
(a) Compliance with Legal and Regulatory Requirements
Most of our services are subject to legal and regulatory constraints that require us to collect, use, and store your personal information in specific ways. For example, KCEX must identify and verify customers using our services to comply with anti-money laundering laws across jurisdictions. This may involve collecting and storing your identification photos. If you do not provide the personal information required by law, we may have to close your account.
(b) Enforcement of the Terms of this Agreement
We actively monitor, investigate, prevent, and mitigate any potential illegal activities, enforce agreements with third parties, and prevent and check behaviors that violate this agreement. Additionally, we may need to charge fees based on your use of our services. We collect information about your account usage and closely monitor your interactions with our services. We may use your personal information for these purposes.
(c) Detection and Prevention of Fraud and/or Financial Loss
We process your personal information to assist in the detection, prevention, and reduction of fraudulent and abusive activities on our services, and to protect you from account damage or financial loss.
(d) Provision of Services
We process your personal information to provide services to you, particularly in the context of Know Your Customer (KYC verification) procedures. For instance, when you wish to register and verify your account on our platform, we require specific identity and contact information. These procedures are established to ensure the security of your transactions and protect your rights and interests.
(e) Provision of Service Communications
We will send you information related to managing your account, keep you informed of the latest information about our services, notify you of relevant security issues or updates, or provide other transaction-related information. If you miss these communications, you may miss important matters related to your account, which may affect your use of our services. You cannot choose to refuse to receive key service communications, such as electronic mail or SMS for legal or security purposes.
(f) Provision of Customer Service
When you contact us to resolve any issues or disputes, we will process your personal information. If we do not process your personal information, we will be unable to respond to your requests and ensure your continued use of the service.
(g) Ensure Network and Information Security
We process your personal information to enhance security, monitor and verify identity and access to our services, combat spam or other malicious software or security risks, and comply with applicable security laws and regulations. Threats on the internet are constantly changing, and it is particularly important for us to obtain accurate information about your use of our services in a timely manner. If we do not process your personal information, we may be unable to ensure the security of our services.
(h) Use for Research and Development
We process your personal information to better understand how you use our services and how you interact with our services. Additionally, we will use this information to customize, measure, and improve our services, as well as the content and layout of our website and applications, and develop new services. If we do not process your personal information, we may be unable to ensure you continue to enjoy our services.
(i) Enhance Your Experience
We process your personal information to provide a personalized experience and meet your needs. For example, you may allow us to access specific personal information stored by certain third parties. If we do not process your personal information, we may be unable to ensure you continue to enjoy some or all of our services.
(j) Facilitate Company Acquisitions, Mergers, or Transactions
In the event of company acquisitions, mergers, or other corporate transactions, we may process any information related to your account and use of our services. If you do not want us to process your personal information for these purposes, you can choose to close your account.
(k) Conducting Marketing Activities
We may send you marketing communications (such as emails or SMS) to inform you about our activities or partner activities, provide targeted marketing, and offer promotional discounts. Our marketing will be conducted in accordance with your advertising and marketing preferences and applicable legal requirements.
(l) Other Purposes
We may use your personal information for other purposes based on your consent.
4. KCEX will not provide, sell, rent, share, or trade your personal information with any unrelated third parties, unless with your prior consent, or if that third party, independent or jointly with KCEX (including KCEX's affiliated companies), provides services to you, and after the termination of such services, that third party will be prohibited from accessing any of your data that was accessible during the service period, whether in part or in whole. KCEX also does not allow any third party to collect, edit, sell, or freely distribute your personal information in any way. If any KCEX user engages in such activities and is discovered, KCEX has the right to immediately terminate the service agreement with that user.
5. If you do not have full legal capacity and full legal eligibility, please do not use this service. Therefore, we hope you do not provide us with any personal information.
Information Disclosure
6. Under the following circumstances, KCEX may disclose your personal information in whole or in part based on your personal preference or legal requirements:
(a) Disclose to a third party with your prior consent;
(b) If you are a qualified intellectual property complainant and have filed a complaint, disclose it to the respondent at the request of the respondent to assist both parties in handling possible rights disputes;
(c) Disclose to a third party, administrative agency, or judicial authority in accordance with the relevant provisions of the law, or at the request of an administrative agency or judicial authority;
(d) If you violate relevant laws, regulations, or this agreement, disclose it to a third party;
(e) In order to provide the products and services you requested, we may need to share your personal information with third parties;
(f) In a transaction conducted on KCEX, if either party to the transaction has fulfilled or partially fulfilled the transaction obligations and made a request for information disclosure, KCEX has the right to decide to provide the necessary information, such as the contact information of the user's transaction counterparty, to facilitate the completion of the transaction or resolution of the dispute; and
(g) KCEX may disclose information in circumstances deemed appropriate by KCEX based on laws, regulations, or website policies.
Information Storage and Transfer
7. The information and data we collect about you will be stored on servers of KCEX and its affiliated companies. This information and data may be transferred to your country or region, or to regions outside of where KCEX collects information and data, and may be accessed, stored, and displayed overseas. For personal information transfers of EU users and/or users located in the EU, please refer to the "Additional Terms for EU Users Only."
Use of Cookies
8. Unless you refuse to accept cookies, KCEX will set or access cookies on your computer to enable you to log in or use services that rely on cookies. KCEX uses cookies to provide you with more personalized services, including promotional services. You have the right to choose to accept or reject cookies. You can reject cookies by modifying your browser settings. However, if you choose to reject cookies, you may not be able to log in or use services that rely on cookies. The relevant information obtained through cookies set by KCEX will be subject to this clause.
Information Security
9. Your account has security protection features. Please keep your account and password information safe. We will use security measures such as backing up to other servers and encrypting user passwords to ensure that your information is not lost, misused, or tampered with. However, please be aware that there is no "perfect security measure" on the Internet. When conducting online transactions using this service, you will inevitably need to disclose your personal information, such as contact information or mailing address, to the trading counterparty or potential trading counterparty. Please protect your personal information properly and provide it to others only when necessary. If you discover that your personal information has been leaked, especially if your account and password have been leaked, please contact KCEX customer service immediately so that KCEX can take appropriate measures.
10. We will retain personal information in accordance with personal data protection laws and/or other applicable laws. In other words, when we reasonably determine the following situations, we will destroy or anonymize your personal information: (i) retaining this personal information no longer meets the purpose of collecting such personal information; (ii) retaining this personal information no longer has any legal or business necessity; (iii) no other legitimate interests require further retention of this personal data. If you stop using this service, we may continue to store, use, and/or disclose your personal information in accordance with this privacy policy and the obligations required by personal data protection laws and/or other applicable laws.
Withdrawal of Consent, Deletion, Request for Access, or Modification of Information Provided to Us
11. You can withdraw your consent for us to collect, use, and/or disclose your personal information that we own or control by sending an email.
12. However, withdrawing your consent may mean that we can no longer provide you with services, and we may need to terminate the agreement between you and us.
13. You can request access to and/or correction of personal data currently owned or controlled by us by submitting a written request to us. We will need you to provide sufficient information to verify your identity and the nature of your request in order to process your request. Therefore, please submit your written request by sending an email.
14. We may charge you reasonable fees for processing your request for access and/or correction of personal data. If we choose to charge fees, we will provide you with a written estimate of the fees we will charge. Please note that unless you agree to pay the fees, we are not obligated to respond to or process your request.
15.We reserve the right to refuse to correct your personal data in accordance with the provisions of personal data protection laws and/or other applicable laws, which require and/or authorize us to refuse to correct personal data under specified circumstances.
Account Deletion:
16. You can delete your KCEX account at any time. Deleting your account means:
You will lose all digital assets and data content in that account;
You will not be able to retrieve personal information, transaction records, business data, historical information, etc., under that account;
You will not be able to use KCEX services that require logging in with that account.
Important Note: Account deletion is an irreversible action. To protect your rights, we will provide another prompt for relevant risks when you select the delete account button.
17. Account deletion does not exempt or reduce your account actions and related responsibilities before the account is logged out. Account deletion means that all records and information related to your account will be deleted, but we may still retain certain information about your account as required by applicable laws and regulations.
Additional Terms for EU Users Only
18. The provisions in this section apply only if you are an EU user. These terms take precedence over any inconsistent terms in the rest of this Privacy Policy.
19. Your personal data may be transferred outside of the EU. In such cases, we will take all reasonable precautions to ensure compliance with the appropriate security measures required by GDPR. For example, we will adopt appropriate contract terms to ensure that recipients of such transfers protect and process your personal data in accordance with all applicable personal data protection laws.
20. Under GDPR, you have the right to:
a) Access your personal information and correct any inaccurate information, and object to the collection of personal information, subject to legal requirements;
b) Delete information collected solely based on your consent, or retain this personal information if it no longer serves the purpose for which it was collected;
c) Restrict the collection of such data when the original purpose for collecting such data is no longer necessary;
d) Request the right to provide personal information in a structured, commonly used, and machine-readable format;
e) Withdraw your consent at any time without prejudice if the collection of user information is solely based on your consent.
